- First: when someone gets arrested in California for a criminal matter that occurred in another state. A warrant is issued and the person is arrested in California on an out-of-state warrant. Mr. Wallin will request an Identification Hearing in California because California law protect people arrested in California and won’t release that person to another state unless that person is proven to be the same person on the warrant.
- Second: when a person is arrested in another state for a warrant in California. In this situation, the district attorney in California is contacted and assigned the case where he and she assists the other state in extraditing (or transferring) the defendant back to California for prosecution.
