Expulsion/suspension process:

The expulsion/suspension process is not a judicial action but an administrative matter that involves teachers and school boards.  The first part of the expulsion/suspension process is a panel hearing that consists of three teachers from another school within the district who listen to testimony from school officials and testimony on behalf of the child regarding the alleged behavior leading to the disciplinary action. The panel then makes one of the following recommendations to the school board: to return the child to school; suspend the child; transfer the child to another school within the district; or, expel the child from the district.

The school board makes the final decision regarding disposition of your child's case. Even if your child commits an offense where expulsion is required by the Education Code, the school board may suspend the expulsion.  An experienced California criminal defense attorney can negotiate expulsion/suspension actions with the goal of keeping the child in his or her current school or district. Thomas Wallin is experienced in these matters and is ready to represent your family, so call today at 1-866-857-5900.
